Bankruptcy Litigation

Thelen LLP represents clients in all aspects of bankruptcy-related litigation, including fraudulent transfer and preference actions, valuation and "cramdown" issues, use of cash collateral, and lender liability actions. The firm's litigation strength in bankruptcy also enables us to represent clients in structuring their transactions to minimize their exposure with respect to such matters.

Our attorneys have vast experience representing unsecured creditors' committees, secured and unsecured creditors, contract parties, examiners and Chapter 11 trustees, Chapter 11 debtors, and purchasers of assets out of bankruptcy.

Thelen has had significant successes in Chapter 11 cases representing parties in industries such as health care, telecommunications, energy, manufacturing, and transportation. In Chapter 11 cases filed by hospitals and other health care providers, for instance, Thelen has represented eight unsecured creditors' committees, two creditors' trusts, two Chapter 11 debtors, and a Chapter 11 trustee. We also defend parties in preference, fraudulent transfer, alter ego, and other litigation brought by trustees, creditors' committees, debtors, and others.
