Professional Experience

Mr. Neulight represents employers in all aspects of employment and labor law in a wide range of industries, such as healthcare, technology, utilities, construction, and retail. Sample experience includes:

  • Employment litigation before state and federal courts and administrative agencies involving claims of discrimination and harassment (sex, race, religion, national origin, disability and others); tort (fraud, assault and battery, interference with contract, defamation, intentional infliction of emotional distress); breach of contract; unfair competition; unpaid wages; and stock option disputes.

  • Wage and hour class actions involving claims of employee misclassification, unpaid overtime, failure to receive rest and meal periods, and failure to pay prevailing wages. Recent cases involved defense of such claims asserted against electric utility company, construction contractor, and retail clothing store chain.

  • Arbitrations on behalf of employers involving claims of fraud, breach of contract, wrongful discharge, and unfair business practices.

  • Injunction and declaratory relief actions involving claims of employee raiding and theft of trade secret information.

  • Represent employers in administrative proceedings before National Labor Relations Board, U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, California Department of Fair Employment and Housing, and California Division of Labor Standards Enforcement. Recent cases involved wage complaints, EEO complaint conciliation, union representation election proceedings, and unfair labor practice charges.

  • Advise employers on litigation avoidance and employment law compliance on matters including wage and hour practices, reductions-in-force, employee discipline and termination, disability accommodation, and leaves of absence. Draft executive employment contracts, confidentiality/non-solicitation agreements, personnel policies, employee handbooks, arbitration agreements and consulting contracts.
